SECURITY LIGHT AGREEMENT

1. BPU will install a 150-watt high pressure sodium security light(s), controlled by a photocell, for the customer on existing BPU poles. Security light(s) will be placed where it is easily accessible to BPU equipment and personnel for construction and maintenance.

If there are no existing poles, poles and wire will be charged to the customer on a case-by-case basis.

2. BPU will maintain the lighting unit(s) and replace, without expense to the customer, all lamps that fail due to normal use or other causes not of vandalism nature. Any lamp replacements due to vandalism will be paid for by the customer. BPU shall not be required to make periodic inspections, but the customer will notify BPU of any needed maintenance which will be done by BPU, within a reasonable amount of time after receiving notification from the customer.

3. The customer agrees to pay a monthly charge, plus applicable taxes, per light, in accordance with BPU’s current electric rate schedule. This charge will be a separate line item on the customer’s regular monthly bill from BPU.

4. BPU has the right to disconnect a security light, if the customer becomes delinquent with BPU on their monthly bill, in accordance to BPU’s Disconnection Policy (Policy 2005-10).

5. Upon written request by the customer, BPU will remove the security light(s) from the customer’s property at BPU’s earliest convenience.

6. In the event the supply of electric current should be interrupted or fail by reason of accident, or conditions beyond the control of the utility, BPU will not be liable for damage by reason of such interruption or failure. The customer has read this agreement and agrees to the rules that BPU has set forth.
